This is an Application for condonation of delay of 1 year and 95 days in filing the Appeal against the judgment and order dated 6.2.2024 passed by the Additional Sessions Judge, Solapur in Sessions Case No.144/2019. The Applicant was convicted for commission of the offence punishable under Section 326 of IPC and was sentenced to suffer RI for seven years and to pay a fine of Rs.5,000/-.

Heard Mr. Nikhilesh Pote, learned counsel for the Applicant and Mr. S.H. Yadav, learned APP for the Respondent-State.

Learned counsel for the Applicant submitted that the Applicant is from a poor financial background. He could not afford to engage a private Advocate and this Appeal is filed with the help of the Legal Services Authority of this Court. Some time was required to collect the papers and to file this Appeal. Therefore, there is delay of 1 year and 95 days in filing the Appeal. He further submitted that the Applicant is in custody for more than three years. 4.

Inspite of this, learned APP opposed this application for condonation of delay.

I have considered these submissions. I have taken into account the submissions made by learned counsel for the Applicant. This Application deserves to be allowed in the interest of justice and on the basis of submissions made by learned counsel for the Applicant.

Hence, the following order is passed :

O R D E R

(i) The Application is allowed. The delay of one year and ninety five days, is condoned.

(ii) The Appeal be processed further.

(iii) Interim Application is disposed of accordingly. (SARANG V. KOTWAL, J.)
