Heard learned counsel appearing on behalf of the Applicant and Ms Hirvale, learned APP for the Respondent-State. 2.
By the order dated 13th June 2025 passed by this Court in Interim Application No. 1471 of 2025, the Applicant was granted temporary bail for a period of six months commencing from 13th
June 2025 subject to execution of P.R. bond and on a further condition that the Applicant's son would stand as a surety. The present Application had been filed inter alia for allowing the Applicant's uncle to stand as surety in place of his son, since, he does not have any landed property.

Learned counsel has further submitted that there is a mistake in mentioning the C.R. number in the order dated 13th June 2025,. which requires correction. That apart, it is also submitted that since the Applicant could not avail the bail with effect from 13th June 2025, i.e. the date of the order, hence, the bail period be made effective from today, i.e. 21st July 2025. 4.
The learned APP has no objection to the prayers made by the Applicant's counsel.

After going through the application and upon hearing the submissions of the learned counsel, we are of the opinion that since the Applicant has already been granted temporary bail, a condition put in the order dated 13th June 2025 should not unduly prevent him from availing the benefit of the bail order, more so when, the bail was granted for six months so as to undergo medical treatment.

We, accordingly, allow the Interim Application by clarifying that the Applicant's uncle namely, Shri Nainmal Umedamal Rawal shall stand as surety in place of the son of the Applicant. The
temporary bail will be treated to have been granted in connection with C. R. No. 25/2017 registered with the Arnala Police Station in Special Case No. 57/2017 before the Special POCSO Court at Vasai.

We further clarify that the bail period of six months, as per the order dated 13th June 2025, shall commence with effect from today, i.e., 21st July 2025.

The order dated 13th June 2025 stands modified to the above extent.
