It is the submission of the learned counsel for the Appellant/Applicant that Accused No.1 - Siddhaling Pandit Kamane is in custody for more than 10 years. The Accused No.1 is convicted for offence under Section 302 of the Indian Penal Code and is held responsible for the death of his wife and his mother-in-law. There are two injured eye witnesses i.e. PW-1 & PW-2. We propose to keep the Application for suspension of sentence pending, as we want to make an endeavour to hear the Appeal itself finally.
