Heard the learned Counsel for the Applicant and learned APP for the Respondent - State.
2) By the Interim Application No.925 of 2024, the Applicant has sought suspension of his sentence and enlargement on bail. By the order dated 11th March, 2025 the Applicant was directed to be released on bail on furnishing P.R. bond in the sum of Rs.50,000/- with one or two local 'solvent' sureties in the like amount along with other conditions. 3) The learned Counsel for the Applicant submits that the Applicant is poor. His wife is finding it difficult to get a suitable surety/ies
to comply with the said bail Order and avail its benefits. She submits that the Applicant is in custody since 14 years and 10 months. She, therefore, submitted that the Applicant may be permitted to furnish cash bail in lieu of surety for a period of eight weeks. Further, she submits that if this prayer is allowed, the Applicant would furnish the surety as per the Order dated 11/03/2025.
4) Ms. Rane, learned APP submitted that considering the facts of the case, necessary Orders may be passed.
5) It is a fact that despite the Order for his release, the Applicant remains in custody till date as he has been unable to comply with the Order dated 11/03/2025. The Applicant's financial incapacity has rendered him unable to comply with the said Order.
6) In the backdrop, we deem it appropriate to allow the Applicant to furnish cash deposit in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) in lieu of furnishing 'solvent surety' for the purpose of his release. However, we make it clear that this is an ad-interim Order which will remain in force for a period of eight weeks to enable the Applicant to arrange for the 'solvent surety' as directed by the Order dated 11/03/2025. The rest of the conditions in the Order dated 11/03/2025 shall remain as it is.
7) Additionally, Suraj Nitin Rathore, the son of the Applicant shall furnish an undertaking on affidavit that he shall keep the Applicant present
before this Court and the concerned Police Station. 8) List this Application on 24th September, 2025 for further consideration.
