The Petition seeking writ in the nature of Habeas Corpus is filed by the wife of one Ganesh More, who has gone missing from

The petitioner - wife alleged that they were known to each other since 2004, as she was his student and they were officially married on 4/08/2020. The petitioner expresses an apprehension that his family members including his brothers, were not happy with the alliance and her husband felt that his brothers and other family members have cheated him and he wrote letters demanding share in his own earning and though an assurance was given by the eldest of the brothers to transfer some properties in his name, there was no compliance and this put him under lot of pressure and he felt frustrated at times.

It is also pleaded in the petition that his family members engaged themselves in foul games against the husband of the petitioner, so as to separate them and this involved her sister-in-law and mother-in-law. It is therefore an apprehension of the petitioner, that on account of such strained relationship, he was abducted, with a sole purpose of separating them from each other. 2.

Though she filed a complaint to the concerned police station about his abduction and also naming the suspects, it is her grievance that no prompt steps were taken by the Senior Inspector of Police, Ulhasnagar Police Station to trace her husband and even till date it is submitted, that he is not found.

In the petition, apart from the State of Maharashtra, the Commissioner of Police, Thane, as well as the Deputy Commissioner of Police, Ulhasnagar along with the Assistant Police Commissioner are impleaded as respondents.

The petition being filed on 18/03/2023, on the notice being issued, we have various reports placed before us by the concerned police station and since the investigation was subsequently transferred to crime branch, even the steps taken by the crime branch from time to time in tracing the missing person are placed on record. At times when the petitioner offered some clue, and we directed the investigation to proceed, for testing the leads and promptly the investigation moved in that direction. However, unfortunately till date the petitioner's husband could not be traced. Though we are informed by the crime branch that the investigation is still going on and the last report placed before us is of 13/08/2025.

Even today, a detailed report of the steps taken to trace the missing person by crime branch under the signature of the ACP, Crime Branch, Thane City is placed before us. Copy of the latest report is furnished upon the counsel for the petitioner. In the 40 page report, we have before us, the steps taken for tracing the petitioner's husband and this includes the minute details of the process that is adopted for tracking him with the help of physical identification by display of photographs as well as by use of technology and tracing him on the basis of CCTV cameras. The search is still in progress and we are assured by the Crime Branch that it shall continue.

However, we find that the petition cannot be kept pending as we find that the State Government has constituted Missing Person

4/4 2 WP 962-24.doc Cell, attached to every police station and with liberty being granted to the petitioner, to report to the said Cell which is headed by ACP, Ulhasnagar, and also in case the petitioner gets some clue or information about her husband. Similarly, we also expect the Missing Person Cell to update her about the further investigation being done after every two months either by calling her to the police station or communicating the relevant information on her email Id or mobile phone number through Whats app.

We are informed that in the spate of anxiety, the petitioner has lodged different FIRs with different police stations involving relatives of her husband and her in-laws, as all the while she suspected her in-laws to be responsible for her husband going missing and we are informed that 7 such FIRs are being registered. The petitioner has gone to the extent of filing FIR against her own husband invoking the offence punishable under Section 376 of IPC and though now such FIRs are being registered, we expect her not to file further FIRs in regards to this subject matter, i.e., holding anyone responsible for his disappearance, as we find that there is no material to establish her accusation that the family members of her husband are responsible for his abduction.

Needless to state, we expect the FIRs to be taken to its logical conclusion by the concerned police station.

With these observations, we dispose of the petition. 6.

In view of the disposal of the petition, the pending Interim Applications do not survive and stands disposed of. (SHYAM C. CHANDAK, J) (BHARATI DANGRE, J.)
