This Interim Application has been filed under Section 5 of the Limitation Act, 1963, with a prayer to condone the delay of 39 days in filing the Appeal against the Judgment and Order dated 11th March 2025, passed by the Additional Sessions Judge, Malegaon, District-Nashik.

We have perused the explanation for delay furnished in the application. Also considered the arguments addressed by the both sides. Learned APP states that she does not have any instructions to file any objection opposing the Application for delay condonation. Taking note of such explanation and being conscious of the fact that the Applicant has a statutory right to prefer the Appeal against the judgment of conviction, we are inclined to condone the delay.

Delay of 39 day is, therefore, condoned.
