By order dated 18th September, 2025, the Superintendent of the Arthur Road Jail was directed to admit the Applicant in Sir JJ Group of Hospitals and give a report to this Court regarding the advise given by the authorities of Sir JJ Group of Hospitals. Accordingly, learned APP has tendered letter of Superintendent, Mumbai Central Prison dated 26th

September, 2025. Attached to the letter are the medical papers of the Applicant. By this letter, the Superintendent of Mumbai Central Prison has confirmed that the medical papers pertaining to the Applicant given by the Authorities of Sir J. J. Group of Hospitals suggested that the said prisoner is advised to follow up with the same doctor who has treated him earlier. In these circumstances, I am inclined to allow the prayer of the Applicant and it is ordered as under:- 2.

The applicant- Naresh Gehrilal Gundecha be released on bail for temporary period of 03 months on his furnishing Personal Bond of Rs.50,000/- and on furnishing one or two sureties in like amount subject to the following conditions : (a) The applicant shall not leave the jurisdiction of Mumbai/Thane/Navi Mumbai.

(b) The applicant shall inform his place of residence within the jurisdiction of Mumbai/ Thane/Navi Mumbai and his contact numbers as also contact numbers of his two relatives residing with him.

(c) The applicant shall attend the proceeding of this Court as and when he is specifically summoned, however he may apply for exemption from personal appearance before this Court, when it is not practicable to him to attend the Court.

(d) The applicant shall report to the Kurla police station through WhatsApp Video Call fortnightly and the Investigating Officer shall allow such reporting through WhatsApp Video Call.

(e) The applicant shall not indulge in any other activities similar to activities on the basis of which FIR is registered against him in present case.

(f) The applicant shall not personally or through anyone make any attempt to influence the witnesses or tamper with prosecution evidence. (g) On completion of period of 03 months of temporary bail, applicant shall surrender to the jail authorities or he may apply for extension depending upon his health: condition supported by medical examination reports.

(h) The applicant shall surrender his Passport to the investigating agency within one week of his release.

(i) In the event, applicant violates any of the conditions, the relief of bail granted by this Court will be liable to be cancelled.
