This is an application seeking modification of condition (ii) in paragraph 6 in order dated 23rd September 2024, passed by this Court in Criminal Bail Application No. 2817 of 2023. According to the Applicant, she has no source of income, her parents have passed away and there is no one in the family to furnish the bail amount.

Heard Mr. Maruti Mhavarkar, learned Counsel for the Applicant and Mr. Kiran Shinde, learned APP for the State. 3.

The Applicant is in custody for the past more than 6 years. Despite the order dated 23rd September 2024 enlarging her on bail, she is continues to remain in custody as she is unable to furnish the PR bond of Rs.25,000/- in one or two sureties in the like amount, as directed by this Court as a condition of bail.

This Court, in the said order, has observed that the Applicant has no criminal antecedents and that the only role attributed to her was as an accomplice. In these circumstances, and considering the the financial capacity of the Applicant, condition (ii) is modified to the extent that the Applicant is directed to be released on bail in connection with C.R. No. 131 of 2019 registered with Kurar Police Station, on furnishing PR bond in the sum of Rs.5000/- with one or two sureties in the like amount. The said PR bond shall be

furnished within a period of two months from the date of this order.

Rest of the conditions of the order dated 23rd September 2024 shall remain as it is.

The present application is allowed and disposed of accordingly.
