P.C.:- 1) This is a consecutive Application for suspension of sentence and releasing the Applicant on bail during the pendency of Appeal. 1.1) The first Application preferred by the Applicant, was not pressed by the Applicant, after the concerned Bench expressed its opinion not to grant the said Application. The second Application preferred by the Applicant, was rejected by a speaking Order dated 30th November, 2023. Paragraph No.1 of the said Order reads as under:- 1/2

Learned A.P.P. tenders report dated 28 November 2023. The same is taken on record. It is submitted that the applicant was released on furlough and he has not surrendered to custody. While the applicant was released on furlough in the year 2021 he has committed an offence. Similarly in the year 2023 while on furlough he has committed another offence."

2) By an Order dated 17th June, 2025, the Appeal preferred by the Applicant has been directed to be listed on a particular date for hearing. 3) The reasons for rejection of the Application for bail have been aptly mentioned in paragraph No.1 of Order dated 30th November, 2023, reproduced hereinabove for the sake of brevity. 4) Except passage of time, there is no change in circumstances than prevailing on 30th November, 2023.

4.1) In view of the above, we are not inclined to grant bail to the Applicant during the pendency of his Appeal and the Application is accordingly rejected.
