Learned counsel for the Appellant submits that the Appellant has very good case on merits. This contention is opposed by the learned counsel for Respondent No.2 stating 1/2

38-ia3310-25.doc that after this Court heard the appeal on merits and was not inclined to grant any relief to the Appellant, time was sought and thereafter Appellant remained absent.

This Application is filed after 307 days of dismissal of the appeal by order dated 23rd September, 2024. Admittedly, no reason has been assigned for non-preferring of the application for restoration of the Criminal Appeal No.1384 of 2023 within the reasonable time. Even if the contentions of the Appellant are accepted to be correct, there is absolutely no much less satisfactory reason for not taking steps to restore the appeal even in reasonable period of time.

Having regard to the aforestated facts, this Court finds no reason or justification to allow the application. 4.

In the aforestated facts, Application stands dismissed. In view of the dismissal of the Application for condonation of delay, Appeal also stands dismissed.
