Heard the learned counsel for the Applicants and the learned APP for the State.
We have perused the Application, which seek condonation of delay of 325 days in filing the Appeal.
The Application states that the Applicants are aggrieved by the order dated 05/08/2024 passed by the Special Judge, subsequent to which their property is already sold in the wake of Notification published under Section 4 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (MPID Act).

32-IA-3417-2025.odt The impugned order being passed on 05/08/2024, the Applicants have pleaded that they being the farmers very rarely used to travel outside the village, and it is only when one of the villager told them that the property was sold out by Respondent No.2, inquiries were made and after coming to Mumbai, they secured all the necessary documents and on approaching the lawyer filed the present Appeal.
The delay is, therefore, prayed to be bonafide and unintentional.
Considering the justification offered and in particularly considering the fact that the Petitioners are residents of Mamdel, Taluka Yavat, District Jalgaon, and since we find that the reason to be plausible , the Interim Application is made absolute in terms of prayer clause (a).
