By order dated 16th July 2025, this Court had allowed the Bail Application of the Applicant on certain conditions. Condition (c) of the said order reads thus;

"(c) The applicant shall not leave the territorial jurisdiction of the Trial Court without its prior written permission."

Now, the Applicant has moved Interim Application seeking relaxation of the condition (c), as re-produced herein above.

Heard Mr. Vinay Bhanushali, learned counsel for the Applicant and Ms. Anamika Malhotra, learned APP representing the State.

Mr. Bhanushali, learned counsel appearing for the Applicant, submits that as a condition of the bail order dated 16th July 2025, he is not permitted to leave the territorial jurisdiction of the Trial Court, i.e., Kalyan without its prior written permission. However, the Applicant is implicated in another 2 FIRs.

In order dated 13th December 2023 passed by the Division Bench of this Court, the Applicant is required to participate in the investigation being conducted by Mr. Pankaj Deshmukh, Investigating Officer of the FIRs registered against

him. However, the said officer is investigating crimes from Pune.

Similarly, by order dated 21st March 2025, this Court while allowing the Bail Application No.4576 of 2024 filed by the Applicant, had directed the Applicant to co-operate with the investigation of C.R.No.116 of 2022 and attend the Trial Court at Palghar. Mr. Bhanushali thus, submits that condition (c) in the bail order dated 16th July 2025 will not permit him to comply with previous two orders. Hence, he is seeking relaxation of condition (c) of order dated 16th July, 2025. 7.

Per contra, Ms. Anamika Malhotra, learned APP representing the State, although concedes that it would be difficult for the Applicant to participate in the investigation being conducted at Pune and Palghar, the Applicant ought to have brought this fact to the notice of the learned Single Judge while passing the order dated 16th July 2025. However, she leaves it to this Court to pass appropriate orders.

Having heard both the counsel, I am of the view that in order to comply with previous orders dated 13th December 2023 and 21st March 2025, it is necessary that Condition (c) of the order dated 16th July 2025 be relaxed. The Condition (c) of paragraph 13 of the order dated 16th July 2025 is, therefore, relaxed. However, the Applicant shall keep the Investigating Officer as well as the Trial Court, Kalyan apprised of his whereabouts.

Rest of the conditions of the said order to remain as it is. 10.

Interim Application is disposed of.
