By the present Interim Application, the Applicant seeks relaxation of Condition (v) of the bail order dated 21st March 2025. The Condition (v) of the said order reads thus; "v) Applicants shall attend the trial Court on the first Tuesday of every month between 11.00 a.m. and 1.00 p.m. to mark their presence. If the first Tuesday of the said month falls on a holiday and / or non Court working day, the Applicants shall mark their presence on the next working day;"

According to the Applicant, since the bail order is a common order passed in respect of 2 Applicants and that the trial is being conducted for 2 Applicants in Kalyan and Palghar, respectively, it is not possible for the Applicant to remain present in the Trial Court on Tuesday since the trial is also in respective Court on Tuesday.

Mr. Vinay Bhanushali, learned counsel appearing for the Applicant, prays for relaxation of the said condition. He submits that any other date be specified on which the Applicants are directed to attend the Trial Court pursuant to Condition (v) of the said order.

Ms. Megha Bajoria, learned APP representing the State, has no objection if the Court fixes any other date for marking attendance of the present Applicant. The Applicant is thus, permitted to attend the Trial Court on the first Saturday of every month between 11 a.m. to 1 p.m. The present modification is made in the bail granted in C.R.No.116 of

2022 registered with the Saphale Police Station, District: Palghar.

Rest of the conditions of the said order remain as it is. 6.
