This is an application seeking modification of order dated 17th October, 2024, whereby the Applicant was directed to remain outside the jurisdiction of Kolshewadi Police Station, District Thane, during the pendency of the trial.

Mr. Khandeparkar, learned senior counsel for the Applicant, submits that the charges have been framed and the compliance under Section 294 of the Cr.P.C. is also done. The Stage is now to record evidence of the witnesses. Mr. Khandeparkar tenders on record the attendance sheet of the Applicant demonstrating that the Applicant has attended the Police Station regularly as per the bail order. 3.

The case is regarding an offence alleged to have been committed by the Applicant under the provisions of the Protection of Children from Sexual Offences (POCSO) Act, 2012 and Section 306 of the Indian Penal Code, 1860. 4.

Considering that the victim has committed suicide and the Complainant is the father of the victim, I deem it appropriate to request the Trial Court to record the statement of the Complainant within a period of two months from today. Once the statement of the Complainant is recorded by the Trial Court, the Applicant thereafter, is permitted to enter the jurisdiction of the Kolshewadi Police Station, District Thane.

Rest of the bail order shall remain as it is. 6.

Interim Application is allowed in the above terms and is disposed of accordingly.
