By this application, applicant seeks relaxation of condition imposed on him vide order dated 23/04/2025 that the applicant shall not enter into the limits of Taluka Hatkangale till conclusion of trial. The applicant intends to contest the Zilla Parishad elections from Bharatiya Janata Party. He, therefore, seeks relaxation of the said condition.

Learned advocate for informant strenuously opposed the application contending that applicant has already breached the condition and complaint to that effect is lodged with the concerned police station as well as to the Deputy Superintendent of Police. Therefore, according to him this application is liable to be rejected.

Learned APP, on instructions from the investigating officer who is present in the Court submits that the complaint of the informant was verified and it was found to be correct. 4.
Taking into consideration the fact that the applicant intends to contest the election, I am inclined to allow the application. Hence, the following order:-
ORDER
(I) The application is allowed.
(II) The applicant is permitted to enter into the limits of Taluka Hatkangale during the election period which is between 06/01/2026 to 31/01/2026.
(III) The applicant shall report Hatkangale Police Station everyday at 9:00 a.m. and 09:00 p.m. between 06/01/2026 to 31/01/2026.
(III) Applicant shall not tamper the prosecution evidence in any manner.
(VI) It is made clear that this relaxation is applicable for the period between 06/01/2026 to 31/01/2026 only. With the above directions the application is disposed of.
