INTERIM APPLICATION NO. 3575 OF 2025 1.

By this Application the Applicant/Original Appellant is seeking modification of Condition No. IV imposed by this Court in the order dated 3rd February 2021 whereby bail was granted to the Applicant pending hearing of the Appeal.

The said condition reads as follows :

IV. The applicant shall report to Wavi Police Station at Sinnar on every 15th day of the month and maintain a diary of his attendance duly countersigned by the In-charge officer of the police station or senior police inspector of Wavi Police Station, whatever the case may be.

It is contended on behalf of the Applicant that the condition is onerous and that this Court may consider relaxing the same, particularity because the Applicant is required to visit his work place and frequent reporting to the police station is disturbing his work schedule. Purti Parab

It is contended that till date the Applicant has abided by the said condition.

On the other hand, Learned APP submits that this Court may not grant the prayer as the Applicant is a convicted accused and there is possibility of the Applicant absconding.

Having considered the rival submissions, we find that minor modification of the condition can be granted so that the Applicant will be able to balance the time devoted at work place with the requirement of reporting to the police station.

In view of the above, we modify the above quoted condition to read as follows :

"IV. The applicant shall report to Wavi Police Station at Sinnar on every first Sunday of every month between 10.00 a.m. to 12.00 Noon and maintain a diary of his attendance duly countersigned by the In-charge officer of the police station or senior police inspector of Wavi Police Station, whatever the case may be".
