For the reasons stated in the application, the application is allowed in terms of prayer clause (a) and the applicant is permitted to intervene in the matter.
CRIMINAL BAIL APPLICATION NO. 3361 OF 2025:

By this application, the applicant seeks bail in C. R. No. 136 of 2023 registered with Jath Police Station, District Sangli for the offence punishable under Sections 302, 307, 326, 324, 323, 506, 143, 147, 148, 149 of the Indian Penal Code and Section, 4, 25 of Arms Act and Section 135 of The Maharashtra Police Act. 3.
Prosecution case in short is that, the applicant alongwith two co-accused persons have killed Vilas Yamgar and Prashant Yamgar on 11th March 2023 at 9.00 p.m.

Heard learned advocate for the applicant, learned APP for the State and learned advocate for the intervener/informant. Perused the charge-sheet.

It appears from the papers that the applicant has allegedly assaulted the injured Dadasaheb with stone on head. Perusal of Dadasaheb's statement shows that apart from the applicant, other accused namely Sunil @ Shubham Tanaji Yamgar assaulted him on head with iron pipe and Tanaji Yamagar assaulted him with handle of axe on his head. The applicant is arrested on 13th March 2023. The charge-sheet in the present crime is filed on 5th June 2023 and the case is numbered as Sessions Case No. 171 of 2023. So far one witness is examined in the trial. Prosecution has cited 71 witnesses in the charge-sheet.

Learned APP submits that there is one antecedent against the applicant under Section 324, 323, 504 and 506 read with 34 of the Indian Penal Code.

Taking into consideration the role attributed to the applicant of assaulting Dadasaheb, prima facie, it appears that the applicant has not actively participated in the commission of murder of two deceased persons. The trial is not likely to conclude in the near future, the application therefore deserves to be allowed. 8.
In the result, the application is allowed.

The applicant Sahahaji Bira Solankar be released on bail in connection with C. R. No. 136 of 2023 registered with Jath Police Station, District Sangli for the offence punishable under Sections 302, 307, 326, 324, 323, 506, 143, 147, 148, 149 of the Indian Penal Code and Section, 4, 25 of Arms Act and Section 135 of The Maharashtra Police Act on executing Personal Bond in the sum of Rs. 15,000/- with one surety in the like amount.

The applicant shall not tamper prosecution evidence. The applicant shall not enter jurisdiction of Jat Police Station till conclusion of trial. The applicant shall regularly attend the Sessions trial.
