By way of this Application, the Applicant seeks modification of the order dated 21st September, 2023 passed in Criminal Bail Application No.31 of 2022 to the extent that condition (iii) in paragraph No.6 of the said order directing the Applicant to attend Anti Narcotics Cell, Thane City on every first and third Monday of the month between 10.00 a.m. and 12.00 noon initially for a period of one year and thereafter on every first Monday of every month between 10.00 a.m. and 12.00 noon be dropped.

Heard Mr. Pulekar, learned counsel for the Applicant and Ms. Bhosale, learned APP, representing the State.

Ms. Bhosale, has placed on record the Roznama of the Trial Court which indicates that on three days the Applicant was absent. To this, Mr. Pulekar, states that out of three dates only on one date some business was transacted before the trial Court. Be that as it may, since the charges are already framed and the trial is underway, condition (iii) of paragraph No.6 of the order dated 21st September, 2023 can be deleted.

However, it is made clear that the Applicant shall continue to attend all the dates before the Trial Court, unless expressly exempted by an order of passed by the Trial Court. 5.
Any infraction of this condition shall entail cancellation of relaxation of said condition and restoration of the original bail condition.

Interim Application is allowed and disposed of in the above terms.
