This Application is for condonation of delay of 82 days' in filing Appeal against an Order dated 5th April 2025 passed in Special Case No. 24 of 2025.

Perusal of the Application indicates that the Applicants/Claimants themselves are less educated and, on this count, the delay has been caused in preferring the Appeal against the Order impugned.
3.
Learned counsel for the Appellants submits that no mala fide can be attributed against the Appellant for not preferring the Appeal in time and in the facts of the case, the delay deserves to be condoned.

Learned APP as well as learned counsel for Respondent No. 2 opposed the Application.

The perusal of the Application indicates that the Applicants have provided reason for delay condonation. It cannot be said that the delay is willful or deliberate. No prejudice much less irreparable loss will be caused to the Respondents, if the delay is condoned.
6.
Hence, the Application is allowed in terms of prayer clause (a).

The Appeal be registered.

Issue notice to the Respondents, returnable on 12th January 2025.

Learned APP and Mr Kamble waive service of notice on behalf of the Respondent-State and Respondent No. 2, respectively.
