Heard learned Counsel for the parties. The Applicant has filed Additional Affidavit dated 17.10.2025 in support of her application. Statements made in paragraphs 4 to 7 therein are accepted as undertakings to the Court.

This is an application by Appellant/Accused No.3 in above appeal for permission to travel to United States of America ('USA') for a period commencing from 22.10.2025 to 31.01.2026. 3.

The Applicant is convicted under Section 506 of IPC and has been sentenced to suffer simple imprisonment for a period of 1 month and fine of Rs.200/- and 'in default sentence' of simple imprisonment of 15 days. The Applicant has been granted permission to apply for reissuance of passport under order dated 25.03.2025. 1/3

The Applicant has stated in her additional affidavit that her son and daughter-in-law are residing at New Jersey, USA and she wishes to visit and stay with them. The Applicant has disclosed the name of her son, who is a doctor and his address in USA. The Applicant has also disclosed the travel itinerary giving dates and places of stay. 5.

Learned APP has submitted that appropriate order be passed, however, Applicant may be directed to report to concerned police station before and after the travel.

Considering the nature of offence and the fact that the appeal is not likely to be taken up for final hearing immediately, and further considering the additional affidavit and reasons mentioned therein, a case for grant of permission is made out. Hence following order : 7.

The Applicant is permitted to travel to USA for a period between 22.10.2025 to 31.01.2026 subject to following conditions: a) The Applicant shall travel according to itinerary disclosed in the additional affidavit.

b) The Applicant shall inform Sahakarnagar Police Station, Pune City in connection with CR No. 16 of 2008 before leaving the Country and also after returning back to India.

c) The Applicant shall submit a copy of the additional affidavit dated 17.10.2025 along with email ID and her contact number in USA, to the said Police Station. d) The Applicant shall not seek extension of period from foreign soil.
