At the outset, Mr. Yash Jalandria craves leave to correct the nomenclature of the cause title of the Interim Application No. 3659 of 2025 by making the State of Maharashtra as Respondent No. 1 and C.B.I. as Respondent No. 2. Amendment not objected to by Mr. Amit Munde the

learned Special P.P. for Respondent-CBI and Ms. Mahalaxmi Ganpathi, learned APP for the State. Leave as prayed for is granted. Amendment to be carried out forthwith.

By the present Application, the Applicant is seeking condonation of delay of 19 days in the filing the Criminal Revision Application questioning the order dated 9th May, 2025 passed by the Special Judge (CBI), City Civil and Sessions Court, Gr. Mumbai, by which the Discharge Application filed by the Applicant at Exh. 231 in CBI Special Case No. 1638 of 2021 was rejected. 4.

The reasons for the delay as set out in the Application are essentially that the Applicant took time in consultation /seeking advice from legal experts and on account of the ailment suffered by the Applicant during the said period. Applicant has narrated the reasons in paragraph Nos. 4, 5, 6 and 7 of the application.

Mr. Munde, learned Special P.P. for Respondent-CBI and Ms. Ganapathi, learned APP submit that the Applicant has not shown any cause to seek condonation of delay.

Applicant is seeking condonation of delay of 19 days in filing the Criminal Revision Application. There are no malafide alleged or attributed to the Applicant for approaching this Court belatedly. Even otherwise, there is no material placed on record to indicate that the Applicant would have gained by delaying filing of the present Revision Application. Explanation for the delay is accepted. Applicant has shown sufficient cause for condoning the delay of 19 days in filling the revision application.

In view of the above, delay of 19 days in filing Criminal Revision application is condoned. Interim Application No. 3659 of 2025 is allowed . (ASHWIN D. BHOBE,J.)
