DATED : 9th OCTOBER, 2025 P.C. :- 1) The Applicant appears as party in person. This is an Application for bail pending his Criminal Appeal No.629 of 2023. The Applicant was convicted for commission of offence punishable under Section 302 of the Indian Penal Code, in Sessions Case No.255 of 2010, before the Additional Sessions Judge, Pune.
2) In the past, he had preferred Interim Application No.1992 of 2023 in Criminal Appeal No.629 of 2023. The Bail Application was rejected by a reasoned Order. We do not see any reason to take a different view. When we expressed our disinclination to grant relief in this Application, the Applicant who, appeared as party in person sought permission to withdraw 1/2
Manoj 905-APEAL-629-2023.doc this Application. He submitted that the matter be listed for final hearing, since the offence is from the year 2010 and he has family liabilities. Because of this family background, he has a responsibility of a wife, who is suffering from some disorder and has a special child. The Applicant himself is suffering from medical issues.
3) Considering this background, we are inclined to list this Criminal Appeal No.629 of 2023, for final hearing. 4) The Applicant submitted that he would engage another Advocate to argue his case.
5) Considering these submissions, the following Order is passed. :: ORDER ::
(i) The Criminal Interim Application No.3666 of 2025 is allowed to be withdrawn.
(ii) The Applicant is at liberty to engage another Advocate to represent him in Criminal Appeal No.629 of 2023. He shall engage an Advocate within a period of four weeks from today.
(iii) The Criminal Appeal No.629 of 2023 be listed on the weekly final hearing board commencing from 8th December, 2025. (iv) The Interim Application is disposed of.
