The applicants are convicted by the Trial Court for offence punishable under Section 324 of the Indian Penal Code and sentenced to suffer rigorous imprisonment of three years and fine of Rs. 10,000/- each, in default of payment of fine, they are sentenced to suffer further rigorous imprisonment for one year. Since the sentence is a short term sentence and fine is deposited by the applicants and since the applicants were on bail during the trial and as the appeal is not likely to be heard in the near future, the application is allowed.
