This is an application for Anticipatory Bail. 2.

The applicant is apprehending his arrest in Crime No. 770 of 2025 registered at Khar Police Station, for the offences punishable under Sections 316(2) and 318(2) read with 3(50 of the Bharatiya Nyaya Sanhita, 2023.

The allegations against the present applicant and other co-accused are of defrauding the first informant, who is the trustee of educational trust to the tune of Rs.2,07,00,000/-. 1/3

The learned counsel for the applicant and the learned counsel for the first informant jointly submit that the present applicant and the first informant have amicably settled their dispute.

In terms of the said settlement, the learned counsel for the applicant has handed over to the learned counsel for the first informant the demand draft of Rs.1,00,00,000/-. Similarly, the learned counsel for the first informant has handed over to the learned counsel for the applicant a letter addressed to the investigating officer, withdrawing the allegations against the present applicant along with resolution of the trust dated 10.03.2025.

The learned counsel for the first informant submits that the first informant has no objection if the present applicant is released on anticipatory bail.

In view of the above facts and circumstances, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed :

O R D E R

a) The Application is allowed.

b) In the event of arrest of the applicant in connection with rime No. 770 of 2025 registered at Khar Police Station, for the offences punishable 2/3

under Sections 316(2) and 318(2) read with 3(50 of the Bharatiya Nyaya Sanhita, 2023, the applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.

c) The applicant shall attend the concerned police station as and when called by the investigating officer and shall co-operate in the investigation.
