The Applicant has preferred the present Application seeking modification / relaxation of the condition in paragraph No.12 (d) of the bail order dated 27th June, 2025. Condition 12(d) reads thus:- "(d) The applicant shall report to the concerned police station once in every month (i.e. on 1st day of every month) between 10:00 a.m. to 12:00 noon, until further orders."

Heard Ms.Singh, learned counsel for the Applicant and Ms.Bhosale, learned APP representing the State. 3.

At the very outset, Ms.Bhosale, on instructions, objected to the modification / relaxation of the aforesaid condition on the ground that the Applicant is a resident of Uttar Pradesh and it will be very difficult to secure his attendance if the said condition is modified / relaxed. She thus, contests the present Application.

Ms.Singh, submits that the statement of the complainant / victim has been recorded by the Trial Court and no purpose will be served by directing Applicant to continue to appear before the police station. She also submits that the the Applicant is unwell and his health condition has deteriorated on account of his incarceration. In these circumstances, she prays that the condition be relaxed. 5.

It appears that the statements of all three witnesses are recorded by the Trial Court, and hence I see no reason for

(P.A.) 907-IA-3727-2025.doc the Applicant to continue to appear before the police station every month. However, there is some substance in Ms.Bhosale's submission that the Applicant may abscond and not be present to face the trial. In these circumstances, conditions (d) in paragraph No.12 of the order dated 27th June, 2025 is relaxed to the extent that the Applicant shall report to the concerned police station once in every two months i.e. on first day of every second month between 10:00 a.m. to 11:00 a.m.

Interim Application is allowed and disposed of accordingly.
