INTERIM APPLICATION NO. 3744 OF 2025:

For the reasons stated in the application, the application is allowed in terms of prayer clause (a) and the applicant is permitted to intervene in the matter.

CRIMINAL BAIL APPLICATION NO. 3702 OF 2025:

By this application, the applicant seeks bail in Crime No. 386 of 2025 registered with Tembhurni Police Station, District Solapur for the offence punishable under Sections 103(1), 61(2) of Bhartiya Nyaya Sanhita, 2023 and under Sections 4, 25 of the Arms Act.

Prosecution case in short is that, one Umesh Londhe lodged a complaint alleging therein that he resides in his house along with sons and daughter and father Ramesh Londhe and mother Reshma. His brother Hanumant Londhe and his wife are residing at Pune. Near of his house there is house of Ramchandra Londhe and wife Ujwala, sons Omkar and Avinash are residing jointly in their house. Father of Ramchandra i.e. Uttam Londhe and step brother Balaji Londhe are residing at village Wangi and they are doing agricultural work. 4.

It is stated that there is a dispute in between them with Ramchandra Uttam Londhe and his sons in respect of agricultural and house property. One civil suit is also pending in Madha Court and other criminal cases are also pending. On 23/06/2025 at about 3:00 pm his father Ramesh Babu Londhe had come towards house from field and he narrated to him as well as other family members that Uttam Ganpat Londhe, Ramchandra Uttam Londhe, Balaji Uttam Londhe, Avinash Ramchandra Londhe, Omkar Ramchandra Londhe

and Ujawala Ramchandra Londhe were seated in their field and they were discussing about the landed and house property dispute. At that time, Uttam Londhe and Ramchandra Londhe threatened to kill him. Therefore, he had come towards house and informed to him. 5.

It is further stated in his complaint that on 26/06/2025 at about 7:30 Omkar Ramchandra Londhe and Avinash Ramchandra Londhe left their house on their motor-cycle. At that time, in his house, Ujawala Londhe and Ramchandra Londhe were present. He reached in his field at about 8:00 am, at that time his father told to him that he will come with tiffin at about 9:30 am and told him to come on motor-cycle. Therefore, he completed his agricultural work and proceeded on motor-cycle for bringing his father towards field from his house. At about 10:00 a.m., he was going towards his field on Ropale to Jakhale road near the field of Subhash Maruti Pawar. On road, Ramchandra Uttam Londhe, Omkar Ramchandra Londhe and Avinash Ramchandra Londhe were assaulting to his father by means of Koyata. He shouted loudly.

They come towards him for assaulting to him. On hearing his voice, his wife Uma, mother Reshma, uncle Dattu Londhe and wife of his brother Sima Londhe had come towards him. At that time, three persons ran away from the spot. He also narrated said incident to his family members. His father was lying on surface, blood was oozing from injury and he died on spot.

Heard learned advocate for the applicant, learned APP for the State instructed by the officer from the concerned police station who is present in the Court and learned advocate for the informant. Perused the charge-sheet.

The applicant is arrested on 26th June 2025. Perusal of the charge-sheet shows that accused no. 1 i.e. father of the applicant Ramchandra Londhe surrendered to the police station after commission of crime at 10.30 a.m. and confessed that he has committed murder of the deceased with chopper. Prima facie, it is seen that though the incident has taken place at 10.00 a.m. in the morning, F.I.R. is lodged at 5.00 p.m. Admittedly, there are disputes going on between the applicant's family and family of the deceased. Criminal cases are also lodged by both parties against each other. 8.

Post mortem report reveals that deceased has received seven injuries i.e. incised wounds. The weapons allegedly used in the murder were recovered at the instance of accused no. 1. All the eye witnesses are family members of the deceased. At this stage, possibility cannot be ruled that family members of accused no. 1 are involved in the present crime due to previous enmity and civil dispute.

Taking into consideration the role attributed to the applicant and the fact that prosecution has cited 55 witnesses in the charge-

sheet and though the charge is framed, not a single witness is examined so far, the trial is not likely to conclude in the near future. The applicant therefore, deserves to be released on bail. 10.

In the result, the application is allowed.

The applicant Omkar Ramchandra Londhe be released on bail in connection with Crime No. 386 of 2025 registered with Tembhurni Police Station, District Solapur on executing P.R. Bond in the sum of Rs. 15,000/- with one surety in the like amount. 12.

The applicant shall not enter within jurisdiction of Tembhurni Police Station, Taluka Madha, District Solapur till conclusion of trial.
