Heard Mr. Bhujbal, learned Counsel appearing for the Applicants, Ms. Newton, learned APP appearing for the Respondent-State and Mr. Desai, learned Counsel for the Intervenor.

This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS") by the Applicant seeking pre-arrest bail in connection with CR No.232 of 2025 registered on 23rd April 2025 with the Khadak Police Station, Pune City, Pune, for the offence punishable under Section 303(2) of the Bharatiya Nyaya Sanhita, 2023 ("BNS").

As per the prosecution case, the First Informant has shifted from his old house at 1281, Shukhrawar Peth, Pune to a new house at 1801, Avanti Building, Tilak Road, Pune and in the same shifting the locker has been shifted. It thereafter, transpired that while shifting the locker the Accused - Netaji Arun Jadhav removed gold from the said locker.

As far as the Applicants are concerned their names are not mentioned in the FIR. However, during the investigation it was found that the Applicants are goldsmith and they have purchased the stolen gold.

Mr. Bhujbal, learned Counsel appearing for the Applicants submits that the Applicants have been granted interim protection by order dated 14th July, 2025 passed by a learned Single Judge

which continues till date. He further submits that there are no antecedents.

Ms. Newton, learned APP states that Applicants have not attended the Police Station. Mr. Bhujbal, learned Counsel on instructions states that the Applicants will attend the Police Station as and when called.

Ms. Newton, learned APP on instructions confirm that Applicants have no antecedents.

Perusal of the record shows that, custodial interrogation is not necessary. Accordingly, the Applicants are granted Anticipatory Bail by imposing certain conditions.

In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant No.1- Pravin Sampatrao Jadhav and Applicant No.2- Omkar Sampatrao Jadhav in connection with C.R. No. 232 of 2025 registered on 23rd April 2025 with the Khadak

Police Station, Pune City, District Pune- the Applicants are directed to be releassed on bail on their furnishing P.R. Bond in the sum of Rs.1,00,000/- with one or two solvent sureties in the like amount.

(b) The Applicants shall attend the concerned Police Station on 17th November 2025, 18th November 2025 and 19th November 2025 between 11:00 a.m. to 02:00 p.m. and shall attend the concerned Police Station as and when called till filing of the chargesheet and shall cooperate with the investigation.

(c) The Applicants shall furnish their cell phone number and residential addresses to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicants shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution

evidence and shall not contact or influence the Complainant or any witness in any manner.

(f) The Applicant shall not leave India without prior permission of the Court.

The Anticipatory Bail Application is disposed of accordingly. In view of the disposal of the Anticipatory Bail Application nothing survives in the Interim Application the same is also disposed of. [MADHAV J. JAMDAR, J.]
