The applicant has filed the present application seeking withdrawal of the amount deposited by the accused. The applicant is the complainant in proceedings under section 138 of Negotiable Instruments Act.

Hence, the application is allowed in terms of prayer clause (a), subject to the condition that the applicant shall file an undertaking before this Court stating that, in case the revision is decided against him, he shall return the withdrawn amount along with interest at the prevailing bank rate within eight weeks from the date of such decision.
