The Applicant, who is the Appellant in Criminal Appeal No.216 of 2015, has filed this Application seeking permission to travel abroad. 2.

The Applicant has filed the said Appeal against the judgement and order dated 03rd February 2015 in MCOC Special Case No.12 of 2010, by which the trial court has convicted the Applicant for the offences punishable under Sections 387 read with 120B of the Indian Penal Code, 1860 and sentenced him to suffer rigorous imprisonment for five years. The trial court has further convicted the Applicant for the offences punishable under Sections 3(2) and 3(4) of the Maharashtra Control of Organised Crime Act, 1999 (for short 'MCOC Act') and sentenced him to suffer rigorous imprisonment for ten years.

The permission is sought to travel abroad from 21st December 2025 to 20th January 2026 for the purpose of business meetings. The Learned Counsel for the Applicant submits that the Applicant has various immovable properties in India and thus he is not likely to abscond. It is submitted that on earlier occasion the Applicant was permitted to travel abroad on certain conditions and he has not violated the said conditions. 4.

On the other hand, Learned APP for the Respondent-State submits that the Applicant is convicted for the offences under the provisions of the MCOC Act. It is submitted that the Applicant is a member of organised crime syndicate. It is submitted that thus the permission as sought may not be granted.

I have perused the earlier orders. It appears that the Applicant is seeking permission on one or the other ground. From the letter produced on record in support of the present Application, it is not clear as to why permission for one month is needed. I am therefore not inclined to allow the present Application.
