Heard Mr. Desai, learned Counsel appearing for the Applicant, Ms. Yadav, learned APP appearing for the RespondentState and Mr. Pathade, learned Counsel appearing for the Intervenor/First Informant.

This application is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking pre-arrest bail in connection with C.R. No.88 of 2022 registered with Shrivardhan Police Station, Dist. Raigad, for the offences punishable under Sections 406, 420 read with 34 of the Indian Penal Code, 1860 ("IPC"). It is an admitted position that thereafter Sections 3 and 4 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 ("the MPID Act") have been invoked. 3.

It is the submission of Mr. Desai, learned Counsel appearing for the Applicant that the Applicant is not involved in the crime. He submits that she is mother of one of the main accused i.e. Karuna Singh. He submits that as there is joint account of the Applicant with the daughter, she has also been made accused. He relied on the orders passed by a learned Single Judge dated 29th April 2024 and 30th September 2024 in case of accused Karuna Ravi Singh (Pages 263 to 268). He submits that there are no antecedents against the Applicant. He submits that the chargesheet as far as IPC offences are concerned, has already been filed and therefore, the custodial interrogation is not necessary. Therefore, he submits that the Applicant be granted pre-arrest bail.

On the other hand, Ms. Yadav, learned APP appearing for the Respondent-State and Mr. Pathade, learned Counsel appearing for the Intervenor/First Informant strongly oppose the Anticipatory Bail Application. Both of them submit that although the main accused is Amitkumar Sharma and also Karuna Ravi Singh, the Applicant has also played major role in the crime and the Applicant is beneficiary. Both of them submit that the Anticipatory Bail Application be dismissed.

Perusal of the record shows that the main allegations are against accused Amitkumar Sharma as also against Karuna Ravi Singh. Main accused Amitkumar Sharma has been granted regular bail and Karuna Singh has been granted Anticipatory Bail. As far as the present Applicant-Bina Singh is concerned, she has been granted Anticipatory Bail Application by order dated 29th September 2025 passed by a learned Single Judge (Coram: Amit Borkar, J.) in Anticipatory Bail Application No.2867 of 2024 concerning IPC offences under the same C.R. i.e. C.R. No.88 of 2022.

A learned Single Judge has granted interim protection to the Applicant -Bina Ravi Singh even in the offences under the MPID Act by order dated 8th October 2025 passed in this Anticipatory Bail Application.There are no antecedents against the Applicant. 7.

Thus, in the facts and circumstances, case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant-Bina Ravi Singh in connection with C.R. No.88 of 2022 registered with the Shrivardhan Police Station, Dist. Raigad the Applicant is directed to be released on bail on her furnishing P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall attend the Shrivardhan Police Station, Dist. Raigad as and when called by the Investigating Officer and shall cooperate with investigation.

(c) The Applicant shall furnish her cell phone number and

residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

(f) The Applicant shall not leave India without prior permission of the Court.

The Anticipatory Bail Application is disposed of accordingly. 9.

In view of the disposal of the Anticipatory Bail Application, nothing survives in the Interim Application and the same is also disposed of.
