Registry has not placed papers of the matter before this Court, however, in view of the medical urgency stated by the learned counsel for the Applicant, an additional copy of the Bail Application is taken from her and this Court has proceeded to hear the matter.

The Applicant seeks his release on bail for a period of 14 weeks for treatment of his chronic case of pancreatitis, during
the pendency of trial in connection with the C.R.No.544 of 2023 dated 25th December 2023 registered with the Chunabhatti Police Station, Brihanmumbai City for the offences punishable under Sections 302, 307, 120-B of the Indian Penal Code, 1860 ('IPC') and Sections 3 and 25 of the Arms Act, 1959 and Sections 37(1)(a) and 135 of the Maharashtra Police Act, 1951.

I have heard Ms. Ashwini Jadhav, learned counsel appearing for the Applicant. She has placed on record medical papers pertaining to the Applicant given by P. D. Hinduja National Hospital & Medical Research Centre, Mumbai. Report dated 6th August 2025 given by Medical Authorities of the Taloja Central Prison, Navi Mumbai indicates that the Applicant was examined by the Medical Authorities of Sir JJ Group of Hospitals, where he was advised USG abdomen/ pelvic and X-Ray. The Applicant underwent USG and CT scan of abdomen, which revealed diagnosis of atrophied pancreas with few calcification-changes of chronic pancreatitis.
Calculus of 7x4 mm of 880 HU in head part of pancreas in MPD was also seen. In the opinion of the Doctors, the Applicant requires surgical opinion from the doctors frequently.

Ms. Jadhav, thus submits that the Applicant is desirous of undergoing surgery in a private hospital, namely, P. D. Hinduja National Hospital & Medical Research Centre, Mumbai (for short 'Hinduja Hospital'). For this purpose, the Applicant is seeking bail on medical ground for limited time. 5.
Per contra, Mr. Yogesh Dabke, learned APP representing the State in the matter, on instructions from the Investigating Officer, states that the report of Sir JJ Group of Hospital, Mumbai, where diagnostic tests were conducted, clearly indicates that the chronic pancreatitis from the Applicant is suffering, can be medically managed. He places on record an affidavit dated 3rd November 2025 affirmed by Shri Mrutunjay Hiremath, Assistant Commissioner of Police, Nehru Nagar Division, Mumbai. There is a specific averment in the affidavit
that although the facility of treatment is available at Sir JJ Group of Hospital, Mumbai and that the disease can be medically managed at Sir JJ Group of Hospital, Mumbai, it does not have Medical Gastroenterology Department. Mr. Dabke, also submits that the Applicant is the main accused and the offences as alleged against him are serious in nature. Mr. Dabke also points to the regular Bail Application filed by the Applicant on merits, which is listed on 19th November 2025. However, he leaves it to the Court to pass appropriate orders.

I have heard both the parties appearing for the respective parties.

It is apparent that the Applicant is suffering from acute pancreatitis and he needs to undergo surgery. Although in the opinion of the Medical Authorities of Sir JJ Group of Hospital, Mumbai, such a disease can be medically managed, however, the earlier reports in respect of the Applicant when he was being treated in Hinduja Hospital, Mumbai, reveal that the
Applicant requires to undergo surgery, which is not possible in Sir JJ Group of Hospital, Mumbai since they do not have well equipped Medical Gastroenterology Department. It is necessary for the Applicant to undergo surgery. 8.
In these circumstances, I am inclined to grant temporary bail to the Applicant on medical grounds for a period of 3 months from the date on which he is released from the jail. The Applicant shall keep the Taloja Jail Authorities informed in respect of his medical details and whereabouts including names of the treating doctors, name of the hospital where he is admitted, and number and names of relatives visiting him in the hospital and other details, as may be required by the Investigating Officer. He shall surrender to the Taloja Jail Authorities immediately after the expiry of 3 months, before 5 pm in the evening on the last day of the 3rd month from the date on which he is released.

Accordingly, the Applicant is directed to be released for a period of 3 months from the date of his release.

It is made clear that the expenses of the treatment in the private hospital be borne by the Applicant.

The Interim Application is partly allowed and disposed of.

Criminal Bail Application No.4019 of 2025, filed by the Applicant, which is to be heard on merits, is adjourned to 13th February 2026.
