This Application is for condonation of delay of 310 days' in preferring an Appeal against the Order dated 9th December 2024 passed by the Special Judge in Special Case No. 71 of 2024. 2.
Learned counsel appearing for the Appellant submits that the Application for Bail filed by the Appellant has been rejected by 7th January 2026
902-CRAPEALST-21218-2025+.DOC the Trial Court. In this regard, a Bail Application has been filed bearing Application No. 826 of 2025. Since, remedy of Appeal is provided in Section 14A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act 1989, the said Application was disposed of. As as result of this, delay is caused in filing of the Appeal.

Mr Gawai, learned APP and Ms Singh, for Respondent No. 2 opposed the application. Apart from the fact that the Appellant has pursued wrong remedy, it is a matter of fact that the Appellant is in jail and his liberty is curtailed. This reason itself is sufficient ground for condoning the delay.

Hence, the Interim Application is allowed in terms of prayer clause (a).

The Appeal is to be registered.

Mr Gawai, learned APP and Ms Singh, waive service of notice on behalf of the Respondent-State and Respondent No. 2, respectively.
