Heard learned counsel for the Applicant and learned APP for the State.

By this application, the applicant is seeking modification of the bail passed by this Court.

It is contention of learned counsel for the Applicant that this Court by order dated 28/04/2025 passed the order that applicant shall not enter within the limits of Raigad District except to attend the dates before the Trial Court. Learned counsel for the Applicant submits that family of the Applicant is staying at Navi Mumbai. Hence, requested to relax/modify the condition.

Learned SPP strongly objected to allow the application on the ground that serious allegations are leveled against the applicant. The first informant is also staying in Navi Mumbai. If the condition is relaxed the Applicant may threaten the first informant and requested to reject the application.

I have heard both learned counsel and perused the order dated 28th April, 2025. Applicant's family stays in Navi Mumbai. He is away from his family around one year.

Considering this fact, I pass following order:
ORDER
(i) Application is allowed.
(ii) The condition imposed on the present applicant that he shall not enter Raigad and Navi Mumbai District. and Applicant shall stay at Mulshi is hereby relaxed.
(iii) Applicant shall report to the Navashewa Police Station once in two months.
