2) Mr.Dube, learned Advocate appearing for the Applicant submitted that, since the date of his arrest the Applicant is behind bars. That, after pronouncement of the impugned Judgment and Order for want of legal and financial assistance, the Applicant could not prefer Appeal within the period of limitation. He submitted that, the Applicant subsequently forwarded an Application to the High Court Legal Services Committee and thereafter he was appointed vide Appointment Order dated 19th July, 2025. 1/2

KSG 30-IA-3932-2025-B.doc That, after getting necessary documents from the Legal Aid Committee he filed this Appeal alongwith the Application for condonation of delay and an Application for Bail. He submitted that, in this entire process the said delay has occurred.

3) In view of the above, for the reasons stated in Application and in the interest of justice, delay is condoned and Application is allowed in terms of prayer clause (c).
