By way of the present Application, the Applicant seeks modification of condition (iii) of the paragraph No.6 of order dated 23rd September, 2024, whereby the Applicant is directed to report to Kapurbawdi police station on 1st Monday of month after every two months until further orders. 2.

I have heard Mr. Solkar, learned counsel for the Applicant and Ms. Rao, learned APP representing the State.

Mr. Solkar submits that the Applicant has suffered a heart attack and has moved to his native place in Chiplun. Considering his health, it is difficult for him to travel to Mumbai to report to the Kapurbawdi Police Station on 1st Monday of month after every two months. Considering his medical requirements, Mr. Solkar prays that the condition (iii) be relaxed.

I have perused the material on record. There is a medial certificate on record pertaining to the Applicant. I have perused the said medical certificate. Considering the averments made in the Application and the submissions made by Mr. Solkar, I am inclined to modify the said condition. Modified condition reads thus:

(iii) The Applicant shall report to the Chiplun Police Station, Taluka Chiplun, District Ratnagiri, on the first Monday of every alternate month between 09:00 a.m. to 11:00 a.m. The Applicant is exempted from reporting to the police station if the first Monday of the month coincides with a date on which the matter is listed before the Trial Court at Mumbai.

The concerned officials of the Chiplun police station shall issue an acknowledgment to the Applicant confirming his attendance.

Rest of the order shall remain as it is.

Interim Application is allowed in the above terms and is disposed of.
