1) This is an Application for restoration of WP No.129 of 2021, which was dismissed for non-prosecution by Order dated 22nd September 2025.

2) The reasons for dismissal of Petition are aptly mentioned in para Nos. 1.1 and 1.2 of Order dated 22nd September 2025. Perusal of present Application reveals that, no explanation, least to say any plausible explanation is offered by the Applicant for not circulating the Petition from 7th February 2023 to 22nd September 2025. Except a general excuse that, on 22nd September 2025, the Advocate for the Applicant could not connect with 1/2

dtg 11-Ia-4027-2025.doc the Video Conferencing link due to technical problem, there is no other pleading in the Application for explaining the lapse on the part of the Applicant / Petitioner and/or his Advocate for non prosecuting the Petition for more than two and half years.

3) Record indicates that, on earlier two occasions i.e. on 15th December 2020 and 22nd January 2021, none had appeared for the Petitioner. That, on 15th December 2020, this Court vacated 'interim relief. On 22nd January 2021, in the absence of the Petitioner, the co-ordinate Bench was pleased to adjourn the matter on 12th February 2021 and was directed to list the Petition under the caption 'For Dismissal'. 4) In view thereof, we are not inclined to restore the Petition. 5) Application is accordingly dismissed.
