This application is for condonation of delay caused in filing appeal against the judgment and order dated 16th January 2024 passed in Sessions Case No.423 of 2019 (Old Session Trial No.114 of 2018). 2.

Learned counsel for the appellant makes solemn statement that the appellant was not granted bail during the trial and hence, the delay be condoned.

Learned APP opposed the application on the ground that the delay is in ordinate of 597 days.

In view of the fact that the appellant is in jail and his liberty is restricted, that itself, becomes a ground for condonation of delay caused in filing the appeal against the impugned judgment and order recorded against him. Hence, application stand allowed in terms of prayer clause (a) and is disposed of.
