This application is moved by the applicant Mr. Ashok Shantaram Thale for urgent relief of his temporary enlargement of bail to enable him to attend the marriage of his daughter, which is scheduled to take place on 15.11.2025.

Learned Senior Counsel appeared on behalf of applicant submits that even without going into the merit of the case it would a fit case to permit the applicant to attend the marriage of his daughter, which is an 1/4
important event in the life of any father. Apart from this, it is the submission on perusal of evidence on records indicates that the applicant is not said to have held any weapon or assaulted any witness in the incident in question, except there is evidence of one witness wherein it is claimed that she was pushed by the appellant / applicant. According to him, applicant was on bail during trial and the fact that he attended the trial indicates no possibility to flee from justice. 3.
Learned APP though opposes the application, on instructions, he makes statement that the applicant has no criminal history behind him. 4.
This Court at this stage does not wish to go into the merits of the case and to record any observations as there are other applications pending of the co-accused for suspension of sentence and enlargement on bail. However, prima facie perusal of the record indicates that there is substance in the contention of learned Senior Counsel appearing on behalf for the appellant with regard to the role of the appellant in the crime in question. He has no previous criminal history and that he is not likely to flee from justice.

Undoubtedly, marriage of daughter would be an important event in the life of any father. There are no circumstances which are exceptional in nature nor the release of the applicant / convict for the temporary period will cause any prejudice to the hearing of appeal. In the circumstances, 2/4
this Court is inclined to exercise the discretion to grant temporary bail to the applicant.

Learned Senior counsel for the applicant on instructions makes statement that if the applicant is released on 14.11.2025, he would surrender to the jail Authorities in any event on 18.11.2025. Statement is accepted as an undertaking. In view of this following order:
ORDER
(i) The applicant- Ashok Shantaram Thale be enlarged on bail on furnishing P.R. Bond of Rs.15,000/- with cash surety to the equal amount.
(ii) The applicant be released forthwith from jail and is directed to surrender to jail the Authorities by 5:00 p.m. on 18.11.2025.
(iii) The applicant not to visit any other place except for his house and place of marriage of his daughter.
(iv) He shall not directly or indirectly to contact victims / injured or any other person connected with crime in question.
(v) Any breach of the condition shall forthwith result into take the applicant in the custody.
