By way of the present Application, the Applicant seeks relaxation of Condition (v) of order dated 4th October 2023. By the said condition, the Applicant is prohibited from entering the area of Shivajinagar, Govandi, till the conclusion of the trial.

Mr. Utkarsh Shukla, learned Counsel for the Applicant, submits that the charges have been framed last month and

that the recording of evidence has not yet commenced. He further submits that the Applicant has complied with all the conditions of the order till date and is now desirous of entering the Shivajinagar, Govandi area since he is a resident of that place.

Ms. Megha Bajoria, learned APP, on the other hand, has brought to my notice that a similar application was made earlier and the said application was rejected. She submits that the offence is serious and it is likely that the Applicant may intimidate the witnesses or tamper with the evidence if he is permitted to enter the said area. She also submits that the Applicant has other criminal antecedents. At this point, Mr. Shukla interjects and states that in the majority of the other criminal cases, the Applicant has been acquitted. 4.

Be that as it may, considering the seriousness of the offence and the antecedents of the Applicant, I am not inclined to allow the Applicant to enter the area of Shivajinagar, Govandi till the conclusion of the trial. However,

considering that the Applicant is desirous of casting his vote in the local election, the Applicant is permitted to enter the area of Shivajinagar, Govandi only on 15th January 2026 between 7.30 a.m. and 5.30 p.m.

The Interim Application is partly allowed and is accordingly disposed of.
