This Interim Application is filed for restoration of the Criminal Writ Petition No.32 of 2023 to its original file. Writ Petition No. 32 of 2023 was listed before this Court on 12th August, 2025. On recording the fact that none appears for the petitioner and in order to give one more opportunity to the petitioner, the matter was listed on 13th August, 2025. Again on observing that even though chance was granted to cause appearance, but nobody has caused appearance, the matter was dismissed for non prosecution on 13th August, 2025. Hence, this application. RAJESHRI PRAKASH AHER 2.
It is submitted that there is delay of 33 days in filing of the present application. The applicant has given reason/explanation RAJESHRI PRAKASH AHER Date: 2025.12.03 11:24:27 +0530 for his non appearance in paragraph no.7 in the interim 27th November 2025 Rajeshri Aher
11 IA 4297 OF 2025.DOC application. The absence of the learned counsel was not willful or deliberate, but occurred due to genuine oversight. The reason for the non appearance by the counsel is sufficiently explained, which appears to be genuine. Hence, in order to subserve the ends of justice, the Criminal Writ Petition No. 32 of 2023 is restored to its original file by recalling the order dated 13th August, 2025. 3.
Interim Application stands disposed of accordingly. 4.
The Writ Petition is restored to its original file. 5.
