This application is for part relaxation of the condition no.4, whereby during the pendency of the trial applicant is prevented from entering district Thane.

Learned counsel for the applicant submits that the applicant is attending the concerned police station so also the proceeding before the Trial Court since 26.11.2024. It is his contention that, at that time 05 witnesses were examined and thereafter not a single witness was examined by the prosecution. It is his 23rd APRIL, 2026

4-IA-4341-2025-BA-555-2024 Navnath Waghmare contention that considering the snail pace at in which trial is conducted the applicant may not be able to enter in the Thane District for ever. He therefore, seeks modification of the condition, 3.

Learned APP, opposes the application by contending that the trial has already commenced and 05 witnesses are examined. 4.

The record indicates that 05 witnesses were examined prior to 26.11.2024, however admittedly thereafter not a single witness is examined. This Court is informed that there are 75 witnesses are yet to be examined. This Court therefore, finds substance in the contention of the learned counsel for the applicant, the pace, at which trial is going on, the applicant may not be able to enter Thane District for years together, which is not contemplated by the order of this Court.

Hence, the condition not to entering the District Thane stands cancelled. However, it is open to the prosecution to move this Court for restoration of the said condition in case it is found that this order is being abused by the applicant in any manner. 6.

In view of the above, application stands disposed of. R. M. JOSHI, J.
