The Applicant seeks his release on bail in connection with C.R. No. 532 of 2024 dated 17th October 2024 registered with the Waliv Police Station for the offences punishable under Sections 318(4), 336(2), 336(3) and 340(2) Bharatiya Nyaya Sanhita, 2023 ('BNS').

Although the Bail Application is filed on grounds other than medical conditions, Mr. Prashant Malik, learned Counsel for the Applicant, states that the Applicant is seeking bail on medical grounds only.

Ms. Poonam Bhosale, learned APP, has placed before me the Health Status Report dated 28th November 2025, under the signature of Dr. Pandurang A. Choure, Medical Officer of the Thane Central Prison. The said report is also accompanied by a medical sheet dated 27th November 2025 in respect of the Applicant's health status, issued by Sir J. J. Hospital, Mumbai. It appears that the Applicant has "acute urinary retention" for which, he was hospitalized and treated at J. J. Hospital. However, it appears from the report that continuous treatment has not been effective.

In these circumstances, I am inclined to enlarge the Applicant on medical bail for six weeks from the date on which he is released from the Thane Central Prison on the

following conditions, to be admitted to a private hospital of his choice, on the following conditions:

ORDER

i) The Applicant be enlarged on medical bail on furnishing provisional cash bail of Rs.25,000/- for his release.

ii) The Applicant is directed to keep the Jail Authorities informed regarding his whereabouts and his medical details including, but not limited to the name of the Hospital in which he is proposed to be admitted and operated; name of the treating doctors; name and phone numbers of the family members/relatives visiting the Applicant and other such details, which may be required by the Jail Authorities/ Investigating Officer within a period of 8 days from the date of his release from jail.

iii) The Applicant shall attend the Trial Court through Video Conferencing. He is, however, at

liberty to move an application seeking exemption from appearance from the trial. Trial Court to decide such application, if made, on its own merits. iv) The Applicant shall not tamper or attempt to influence or contact the complainant, witnesses or any person concerned with the case;

v) Any infraction of the aforesaid conditions shall entail cancellation of bail;

vi) On the expiry of the last day of the sixth week of his release, the Applicant is directed to surrender before the authorities of the Thane Central Prison at or before 3:00 p.m.

Accordingly, the Bail Application seeking bail on medical grounds is allowed on the aforesaid directions and disposed of.

In view of the disposal of the Bail Application, nothing survives in the Interim Application and the same is accordingly disposed of.
