Learned Counsel for the Applicant on instructions, restricts his application for modification of condition no. (v) in order dated 22.04.2025.

On instructions, he makes statement that the applicant would attend all dates of hearing unless exempted by the Trial Court by passing specific order.

Learned APP opposed the application.

Once trial has commenced, there is no propriety in asking the applicant to attend the Trial Court on 1st Tuesday of every 10th March, 2026

By seeking such condition in force, it will preclude the Trial Court from fixing the dates of hearing as per convenience In order to avoid said difficulty, and in view of the undertaking of the applicant through his Counsel for attending the Trial Court on the each date of hearing unless exempted by the specific order, the modification is necessary. 5.

In view of the same, condition no.(v) stands vacated. Application is allowed in above terms.
