By way of the present Interim Application, the Applicant seeks cancellation of condition (iii) of order dated 9th December 2024. The condition (iii) reads thus; "(iii) The applicant shall mark his presence at DCB, CID Mumbai on first Monday of every month between 11 am to 1 pm for a period of three years or till the conclusion of the trial, whichever is earlier."

Mr. Deepak Gautam, learned counsel appearing for the Applicant, submits that there is a change in circumstances 24th December 2025

908-IA-4534-2025.DOC from the date of passing said order inasmuch as the trial has commenced and as many as 7 witnesses have been examined out of about 20-21 witnesses intended to be examined by the prosecution.

Ms. Anamika Malhotra, learned APP representing the State in the matter, submits that the Applicant resides in Haryana and he has complied with the aforesaid condition (iii) till date.

In these circumstances, I am of the view that the interest of justice will be sub-served if the condition (iii) is relaxed and deleted from the conditions imposed by the said order. 5.

Accordingly, condition (iii) of paragraph 10 of the order dated 9th December 2024, stands deleted.

Rest of the order remains as it is.

7.

Interim Application is allowed and accordingly, disposed of.
