P.C.:- 1) This is an Application for condonation of delay of 301 days in preferring present Criminal Appeal against conviction. 2) Mr. Garg, learned Advocate appointed to represent Applicant submitted that, since the date of arrest, the Applicant is behind bars and on the date of pronouncement of impugned Judgment and Order dated 6th December, 2024, for want of legal and financial assistance, he could not prefer an Appeal within the period of limitation. He submitted that, subsequently the Applicant filed an Application with the High Court Legal 1/2

ssm 18-ia4536.2025.doc Services Committee, Mumbai for appointment of an Advocate to represent him and after appointment of the learned Advocate, present Application along with substantive Appeal are filed. That, in the said entire process, the delay has occurred.

3) In view thereof, for the reasons stated in Application and in the interest of justice, delay is condoned and Application is allowed in terms of prayer clauses (a) and (b).
