By way of the present Interim Application, the Applicant seeks modification of condition (c) of paragraph 5 of bail order dated 30th October 2023 passed by this Court (Coram: M.S.Karnik, J.). The said condition reads thus; "(c) The applicant shall attend the Investigating Officer of Wadala T.T. police station once in a month every first Monday of the month between 11.00 a.m. and 1.00 p.m."

Mr. Anil Bansode, learned counsel appearing for the Applicant, submits that the Applicant has been complying with the said condition for the past 2 and half years, however, till date, charges are not framed. Mr. Bansode, further submits that the Applicant is a labourer and every time when he has to visit the police station concerned, his daily wages suffered so also, he is unable to get leave. In these circumstances, he submits that the said condition be deleted.

Ms. Manisha Tidke, learned APP representing the State in the matter, admits that charges are not framed, however, says that in stead of attending police station concerned once in a month, it will suffice the purpose if the Applicant is directed to attend the police station concerned as and when required by the Investigating Officer.

Accordingly, condition (c) of paragraph 5 of bail order dated 30th October 2023 is modified to the extent that the Applicant shall attend the Investigating Officer of Wadala T.T.

Rest of the order remains as it is.

The Interim Application is accordingly, partly allowed and disposed of.
