Commercial Suit No. 3 of 2024 has been rejected. 2.

We have heard the learned Counsel for the parties and consider it appropriate that in view of the Plaintiffs' Exh.10 - Application for appointment of Commissioner in respect of 37.8% claim of the Plaintiffs as per the Development Agreement dated 4th October 2011 filed on 1st August 2025 is to be determined, till the Commissioner is appointed, there shall be status quo maintained in respect of 37.8% claim of the Plaintiffs as per the Development Agreement dated 4th October 2011.

The District Judge-2, Kalyan, District Thane, who is hearing the Exh.10 Application is requested to hear and dispose of the Application within a period of four weeks from today. 4.

The learned Counsel for the Respondents has tendered Affidavit in Reply, which is taken on record. 5.

The Commercial Appeal From Order is disposed of in these terms. There shall be no order as to costs. 2/3
