The Plaintiff Nos.1 and 2 have sought Decree of Divorce by mutual consent and for dissolution of the marriage under Section 32B of the Parsi Marriage and Divorce Act, 1936. 2.

The Plaintiffs got married at Dadiseth Atashbehram Fanaswadi, Dadyseth Agiary Lane, Mumbai 400 002 on 24th November 2009 in presence of all the family members as per Section 6 of the Parsi Marriage Act. The marriage was solemnized Digitally signed by SUMEDH NAMDEO SONAWANE Date:

within the local limits of the Ordinary Original Civil Jurisdiction of this Court, in accordance with law. The marriage was registered by the Registrar of Parsi Marriages. After the lawful wedlock, one child named Ms. Sanaeah was born. The said minor daughter is currently residing with and in the lawful care and custody of the Plaintiff No.1-father. The Plaintiffs on account of disputes in between them have decided to live separately since 1st February 2022.

The Plaintiffs have now decided to mutually settle in inter se disputes and have their marriage dissolved for which they have exchanged Consent Terms which are Exhibit-D of the Suit (page Nos.17 to 22) 4.

Having considered the reasons set out in the Suit, I am satisfied that the Suit be allowed. The Suit is accordingly allowed in terms of prayer clauses (a) and (b).

Hence the following order:

i.

the marriage solemnized between the Plaintiff Nos.1 and 2 on 24th November 2009 at Dadiseth Atashbehram Fanaswadi, Dadyseth Agiary Lane, Mumbai 400 002 is dissolved under Section 32-B of the Parsi Marriage and Divorce Act, 1936 in terms of 2/3

the Consent Terms.

ii.

The Suit is made absolute in terms of prayer clauses (a) and (b).

iii.

Decree of Divorce be drawn up accordingly.

iv.

The Parsi Suit No.4 of 2025 is disposed of accordingly. 6.
