Application in Election Petition (L) No. 26326 of 2025 is an application by the Returning Officer, Election Commission of India asking for release of the Electronic Voting Machine and deletion of the Election Commission from the array of parties. 2.
Application in Election Petition (L) No. 12012 of 2025 is an application under Order VII Rule 11 of the Code of Civil Procedure, 1908 ("CPC") filed by the returned candidate. Election Petition 9 of 2025 challenges the election by which Respondent No. 1 in that Petition was declared as elected. Stand over to November 17, 2025. 3.
It is made clear that the application under under Order VII Rule 11 of the CPC would be heard first, and the fate of the other application would depend on the success or lack thereof of the said application.

All actions required to be taken pursuant to this order, shall be taken upon receipt of a downloaded copy as available on this Court's website.
