Pursuant to the earlier orders of this Court, today when the matter is called out, Mr. Jadhav, learned Counsel appears for the Petitioner and submits that as directed by this Court, the publication of gazette under Section 109(2) of the Representation of Peoples Act (the "Act") has been effected on 3rd October, 2025. Mr. Jadhav submits that therefore, this Court may grant leave to withdraw the Petition in terms of Section 110 (3) of the Act.

Mr. Karande, learned Counsel appearing for the Respondent No. 6 submits that since the procedure under Section 109(2) has been complied with, this Court may proceed to give directions under Section 110 (3) of the Act.

Mr. Karande, learned Counsel appearing for the Respondent No. 6 also submits that since the cost of Rs. 3,50,000/- have already been deposited by the Petitioner in this Court, this Court may permit the Respondent No. 6 to withdraw the said amount along with accrued interest if any.

Having heard the learned Counsel and having considered their submissions and noting that there does not appear to be any inducement or any bargaining or consideration for withdrawing the Application, the Election Petition is allowed to be withdrawn. Let notice of withdrawal be published in the official gazette within a period of two weeks.

Further, the Respondent No.6 is permitted to withdraw the amount of costs of Rs. 3,50,000/- deposited by the Petitioner in this Court along with accrued interest upon making an application in this behalf and the said amount to be permitted to be withdrawn, subject to due verification.

List for compliance on 8th December, 2025.
